Terms of Service

These terms apply when you hire Advantage New York — IT Solutions to build, host or maintain a website. Paying a deposit or invoice means you accept them. If we have signed a separate written agreement with you, that agreement controls wherever it differs from this page.

1. What we do

We design, build, launch and host small business websites. A package is described on the page you bought it from — the number of pages, the delivery time, what is included and what is not. That description is part of these terms.

2. Price and payment

• Build fees are one-time and quoted before work begins. Prices on this site are current rates and may change for new orders; a quote you have already accepted does not change.
• Work starts once payment is received and your intake is complete.
• Hosting, domain renewal and SSL are billed annually in advance. If an annual renewal is not paid, the site may be suspended after written notice.
• Third-party costs we pay on your behalf — domain registration, premium fonts, stock photography, paid plugins — are either included in your package or quoted separately, and are non-refundable once purchased.

3. Timelines

Our delivery times run in business days and start from a complete intake — meaning all text decisions, photographs, logo files, licence numbers and service details are in our hands. They pause whenever we are waiting on you. A five-business-day build does not become a fifteen-day build because we asked for photographs on day one and received them on day ten; the clock simply stops in between.

4. What you provide

• Photographs of your own work, or written permission to use the images you send us. If you send us images you do not own, you are responsible for that, not us.
• Your logo, if you have one.
• Accurate business details: legal name, trade name, address, phone, hours, service areas.
• Accurate licence, registration and insurance information. We publish the licence numbers and credentials you give us. We do not independently verify them, and you are solely responsible for their accuracy and for whether you are entitled to advertise the services described on your site.
• Timely responses. If a project goes ninety days without a response from you, we may close it and archive the files. Restarting is subject to a re-opening fee.

5. Revisions

Each package includes a stated number of revision rounds on the first version. A revision round means one consolidated set of changes, not a running conversation. Changes that alter the agreed scope — extra pages, a different design direction, new features — are quoted separately before we do them.

6. Ownership

When the build is paid in full, you own the content, images and copy that make up your site, and the domain name is registered in your name. We retain ownership of our underlying templates, code libraries and internal tools, and we may reuse them on other projects. We may display your finished site in our portfolio unless you ask us in writing not to.

7. Hosting and uptime

We host on commercial shared infrastructure. We do not guarantee uninterrupted service and we do not offer an uptime credit. We do keep regular backups and will restore from them at no charge if a site fails for a reason within our control. You may move your site to another host at any time; we will provide the files.

8. Acceptable use

You may not use a site we host to publish unlawful content, to advertise services you are not licensed to provide, to send unsolicited bulk email, or to host malware. We may suspend a site that does, after notice where circumstances allow.

9. Refunds

Because work begins immediately on payment, build fees are refundable only in proportion to work not yet performed, and only before the first version is delivered. After delivery of the first version, build fees are non-refundable. Annual hosting is refundable on a pro-rata basis for the unused whole months remaining. Domain registrations are never refundable, as the registry fee is paid at purchase.

10. Support

Support runs by email and WhatsApp. We reply to support requests within one business day. We do not offer telephone support, and this is deliberate: written support means every instruction, approval and change request has a record both of us can refer back to.

11. Liability

To the extent the law allows, our total liability for any claim arising out of the work is limited to the amount you paid us for that work in the twelve months before the claim. We are not liable for lost profits, lost business, or indirect or consequential damages. Nothing in these terms limits liability for fraud or for anything that cannot lawfully be limited.

12. Termination

Either of us may end a project in writing. If you end it, you pay for the work completed to that point. If we end it for a reason other than your breach, we refund the portion covering work not performed.

13. Governing law

These terms are governed by the laws of the State of New York. Any dispute will be brought in the state or federal courts located in Queens County, New York, and we both consent to that venue.

14. Changes

We may update these terms for new orders by posting a revised version here. The version in effect when you paid governs your project.
